The short version
Your photos, tenant names, addresses, comments, memos, incident reports, statements, signatures, and reports stay on your device. They are not uploaded to our servers, and we cannot see them. If you choose to email us a report or photograph for support, we receive what you send.
We collect only what we need to run your account and subscription: your email address, your name and company details if you provide them, license and device records, and subscription records from our payment processor, Stripe. We use a cookie-free analytics tool that counts visits in aggregate. We do not use advertising, advertising or analytics cookies, or cross-site tracking, and we do not sell personal information or share it for cross-context behavioral advertising.
1. Who we are
1.1 Scope. This Privacy Policy explains how Mark Luft, a sole proprietor doing business as EZ²-Inspect (“we,” “us,” or “our”), handles personal information in connection with the EZ²-Inspect web application (the “App”), the website at https://ez2-inspect.com, and related services (together, the “Services”). It describes information processed by us and our service providers, not the separate records that property owners or managers create and keep on their own devices.
1.2 Terms of Service. This policy forms part of our Terms of Service at https://ez2-inspect.com/terms. Capitalized terms not defined here have the meaning given in the Terms of Service.
2. Information that stays on your device
2.1 Your Content. The App keeps the content you create on your device, including photographs, photo stamps, tenant names, unit addresses, inspection checklists, comments, repair entries, memos, incident reports, the names and contact details of people involved and witnesses, injury descriptions, statements, statement confirmations, signature images, and reports. The App does not upload that content to our servers, and it has no diagnostics, synchronization, or cloud backup features that transmit it. We do not receive copies unless you voluntarily send content to us, such as with a support request.
2.2 When the App contacts our servers. The App contacts our servers only to: (a) load the App and check for updates; (b) check your device clock against internet time; (c) sign you in and check that your trial or subscription is active; (d) start checkout, open the billing page, and, for company accounts, manage licenses; and (e) send anonymous page-view and performance statistics through Cloudflare Web Analytics (see Section 6.2). These contacts carry your account and device identifiers where needed, the App version, the information you enter to buy or manage a plan, and standard technical information such as your IP address. They never include photographs, tenant information, reports, or any other content you create in the App.
2.3 Export backup. The App’s Export backup feature creates a file on your device containing your work. You decide where to save or send that file; it is not sent to us.
2.4 Location. If you turn on GPS stamps, your device reads its location to print coordinates on your photographs. The location is used only on your device and is not sent to us.
2.5 Text messages. The App’s Ask by text feature only opens the messaging app on your device with a suggested message. Messages you send, and any replies, travel through your own phone and mobile carrier. We do not send, receive, read, or store them.
2.6 Reports you share. When you send or save a report, it goes where you choose (for example, email, text, cloud storage, or your files) under that service’s terms. We are not involved.
2.7 Tenants, witnesses, and other people in reports. If you are a tenant, a person involved in an incident, a witness, or another person whose information appears in a report made with the App, that report is controlled by the landlord, property manager, or organization that made it, not by us. We do not hold it and cannot access, correct, or delete it. Please contact them about it.
3. Information we collect
3.1 Account information. When you create an account, we collect your email address and, if you provide them, your name and your company or property name. We keep a record of your acceptance of the Terms of Service and this policy, including the version and the date and time.
3.2 Sign-in codes. To sign you in, we send a one-time code to your email address. Codes expire after a short time and are used only to confirm that you control the address.
3.3 License and device records. For each license, we keep the assigned person’s email address, a random identifier the App creates for each signed-in device (up to two per license), the App version, and the date and time of the last license check. We do not collect device contacts, photos, location, or other content from your device.
3.4 Company accounts. If your organization buys licenses on a company account, we collect the administrator’s name and email address, the organization’s name, the billing email address, the number of licenses, and the email addresses of the people the administrator assigns licenses to. The administrator can see each assigned person’s name, email address, and last check-in date. If you are an employee or contractor using a company license, your organization provided your email address to us.
3.5 Payment and subscription information. Payments are processed by Stripe, Inc. We do not receive or store your full payment-card or bank-account number. Stripe provides us with the information needed to run your subscription, such as your plan, billing status, renewal date, amounts charged, invoices, transaction identifiers, the card brand and last four digits, and the billing address or postal code you give Stripe. We also keep a record of your agreement to the automatic-renewal terms at checkout.
3.6 Messages. If you email us at support@ez2-inspect.com, we receive your email address and whatever you include in your message, including any photographs or reports you choose to attach. Please remove tenant and other personal information we do not need to help you.
3.7 Technical information. Our hosting provider automatically receives technical information when you visit the website or use the App, such as your IP address, browser and device type, the pages or files requested, and the date and time.
3.8 Information on your device. The App stores your settings, work in progress, your email address, your license status, and a sign-in token in your browser’s storage on your device. The sign-in token keeps you signed in. Your settings and work in progress are not sent to us.
3.9 Categories under California law. In the categories used by California privacy law, the personal information we collect is: identifiers (name, email address, IP address, device identifier); customer records and commercial information (organization name, plan, billing and transaction records); and internet or other electronic network activity information (technical and analytics information). We collect it from you, from your organization’s administrator, from Stripe, and automatically from your device. We do not collect sensitive personal information for the purpose of inferring characteristics about you.
4. How we use information
4.1 Purposes. We use the information we collect to: provide and operate the Services; create and secure your account; send sign-in codes; check licenses; manage trials, subscriptions, invoices, billing, receipts, renewal reminders, and price-change notices; keep records of your agreement to our terms; respond to your questions and support requests; communicate with you about the Services, the Terms of Service, or this policy; understand in aggregate how the website and App are used so we can improve them; keep the Services secure and prevent misuse; and comply with the law.
4.2 No advertising or sale. We do not use your information for advertising, we do not sell it, and we do not share it for cross-context behavioral advertising.
5. How we share information
5.1 Recipients. We disclose personal information only to: (a) service providers who help us run the Services: Cloudflare, Inc. (website and App hosting, security, account and license records, and web analytics), Stripe, Inc. (payments, invoices, and the checkout and billing pages), our email delivery provider (sign-in codes, receipts, and reminders), and Zoho Corporation (support email), each of which may use the information only to provide services to us; (b) your organization’s administrator, if you use a license on a company account: your name, email address, and last check-in date; (c) authorities or others when required by law or legal process, or when reasonably needed to protect rights, safety, or the security of the Services; and (d) a buyer, successor, or entity we form to operate the App, in connection with a merger, acquisition, reorganization, or sale of all or part of our business or the App, which must continue to protect the information in line with this policy.
5.2 No sale. We do not sell personal information and do not share it for cross-context behavioral advertising. We do not disclose personal information to third parties for their own direct marketing purposes.
6. Cookies, analytics, and “Do Not Track”
6.1 No tracking cookies. We do not use advertising or analytics cookies, or other technologies intended to track your activity across unrelated websites, and we do not allow third parties to collect information about your online activities over time or across other websites through our Services.
6.2 Cloudflare Web Analytics. We use Cloudflare Web Analytics on the website and in the App to count page views and measure loading performance. It does not set cookies, does not use your browser’s storage, and does not build a profile of you or follow you to other websites. It receives the page address, the referring page, browser and device type, and timing information, and we see only aggregate statistics. It never receives Your Content.
6.3 Strictly necessary technologies. We store a sign-in token in your browser’s storage to keep you signed in, and our hosting and security provider may use cookies or similar technologies that are strictly necessary to operate the Services, maintain security, or prevent abuse. Stripe’s checkout and billing pages use their own cookies under Stripe’s privacy policy.
6.4 Do Not Track. Because we do not engage in cross-site tracking, we do not currently change our practices in response to browser “Do Not Track” signals. If our practices change, we will update this policy and provide any notices or choices required by law.
7. How long we keep information
7.1 Retention periods. We keep personal information only as long as needed for the purposes in this policy: (a) Account, license, device, and company-account records: while the account is active, and for 24 months after the account is closed or after the last sign-in, whichever is earlier, unless a subscription or invoice remains open. (b) Subscription, invoice, transaction, and billing records: 7 years after the end of the tax year in which the transaction occurred, for accounting, tax, and dispute purposes. (c) Records of your agreement to automatic renewal, the Terms of Service, and this policy: for the life of the account and 7 years after it closes. (d) Sign-in codes: until they expire shortly after they are sent, after which they are deleted. (e) Support emails: while needed to deal with your request and for 24 months after it is resolved.
7.2 Longer periods. We may keep information longer where needed to comply with law, resolve a dispute, enforce our agreements, or deal with a security incident, and only for as long as that need lasts.
7.3 Provider logs and backups. Our hosting provider keeps technical logs under its own retention policies, and we do not keep copies of those logs. Records held by service providers may remain in their backups for a limited time under their retention practices and legal obligations.
8. Your choices and rights
8.1 Requests. You may ask to access, correct, or delete personal information we hold about you by emailing support@ez2-inspect.com, subject to applicable law. We may take reasonable steps to verify your identity, usually by confirming that you control the email address on the account. We will respond within 45 days, or tell you if we need more time and why. We may keep information we must retain under Section 7.
8.2 Emails. You can unsubscribe from any non-essential emails at any time. Sign-in codes, receipts, renewal reminders, and price-change notices are service messages that we must send while you have an account or subscription.
8.3 Content on your device. Information kept only on your device is under your control: you can delete it using the App’s features or by clearing the App’s browser or device data. We cannot access, correct, or delete content stored only on your device.
9. California privacy rights
9.1 CCPA status. We are a small business, and we do not currently meet any of the thresholds that make a business subject to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”). If we become subject to the CCPA, we will update this policy and honor the rights it provides.
9.2 Requests from California residents. We nonetheless extend to California residents the right to request access to, correction of, and deletion of the personal information we hold about them, by emailing support@ez2-inspect.com, and we will not discriminate against anyone for making a request. You may use an authorized agent to make a request if you give the agent signed permission and we can verify your identity.
9.3 No sale or sharing. We do not sell personal information, share it for cross-context behavioral advertising, or use or disclose sensitive personal information for purposes that would give you a right to limit its use, and we have not done so in the past 12 months.
9.4 Shine the Light. We do not disclose personal information to third parties for their direct marketing purposes, as described in California Civil Code section 1798.83.
10. Security
10.1 Safeguards. We use reasonable administrative, technical, and physical safeguards for the information we hold, and the Services are served only over encrypted (https) connections. No method of transmission or storage is completely secure. If a security breach affects your personal information, we will notify you as required by law.
10.2 Your device. Because your work stays on your device, its security also depends on your device’s passcode, browser, and settings, and on how you store and share your reports.
11. Children
The Services are intended for business use by adults and are not directed to children. We do not knowingly collect personal information directly from anyone under 18. The App instructs users not to photograph people, especially children. If photographs or reports created by property managers nonetheless depict or describe children or their belongings, including in an incident report, those records remain on the user’s device and are not transmitted to us. If you believe a child has provided personal information directly to us, contact support@ez2-inspect.com and we will delete it.
12. Users outside the United States
We are based in California, and the Services are intended for use in the United States. If you use the Services from outside the United States, the information we collect will be processed in the United States and in other countries where our service providers operate, which may have different data protection laws from those where you live.
13. Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated policy at https://ez2-inspect.com/privacy with a new Effective Date and version. If we make material changes, we will notify you in the App or by email before they take effect.
